Welcome to Bonfire, a mobile application developed and operated by Offbeat Apps LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Bonfire ("App") and any related services (collectively, the "Service").
By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Service.
By creating an account or using the Service, you confirm that you are at least 13 years old and legally capable of entering into a binding agreement. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

Bonfire may offer premium features or content available for purchase ("In-App Purchases"). All transactions are handled through the Apple App Store. Please review the Apple App Store's terms and conditions for payment processing.
We may offer subscription-based services. By purchasing a subscription, you agree to pay the applicable fees and charges. Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period.
All payments and refunds are processed through the Apple App Store according to their terms and policies. We do not control payments or refunds. Please refer to the Apple App Store's refund policy for more information.
Consent to Share Consumption Data with Apple:
By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.
All content, features, and functionality available through the Service are the exclusive property of Offbeat Apps LLC and are protected by intellectual property laws.
You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFBEAT APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Offbeat Apps LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Atlanta, Georgia.
You and Offbeat Apps LLC waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury.
All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
We may modify these Terms at any time. We will notify you of any significant changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes signifies your acceptance of the revised Terms.
